Rental Rules

PREAMBLE

The general terms and conditions set forth hereunder will constitute, together with the Booking Form, the contract for turistic lease stipulated between the Client and Venice homes & holidays of Veronica Brovedani, head office in San Marco 5527, 30124 Venice, P. Iva 03826830279, tax code BRVVNC76B50H294Z , registered as agents of business in brokerage n. 2073 CCIAA Venice.
The Client has checked and chosen the Apartment among those offered and duly described on the website www.hhvenice.com.
The rental contract expires automatically at the end of the agreed term without need of any notice, as its purpose is to satisfy temporary holidays housing needs.

BOOKING CONDITIONS

The acceptance of the reservation is subject to the availability of the apartment when receiving the Booking Form subscribed from the Client and to the payment of a Booking Fee. The booking shall be effective and binding for Venice homes & holidays only after the successful payment of the Booking Fee, upon a confirmation voucher of Venice homes & holidays.
Venice homes & holidays reserves the right to refuse a booking at its own discretion.

PRICE AND PAYMENT

The Client will provide to the payment of the rental price of the Apartment in accordance with the specifications on the Booking Form. All prices are in Euro.
The total rental price refers to the entire rental period.
Unless otherwise provided, each quotation includes: the rental cost of the apartment, furnished and equipped with all needs for a short breaks rental period, the welcoming service between 03.00 p.m. and 07.00 p.m., the initial and final cleaning of the apartment, the bed and bath linen, the consumption of electricity, gas, water and heating for stay shorter than 14 nights.
The total rental price shall not include: the welcoming service after 07.00 p.m., the consumption of utilities for rental period up to 14 nights, the intermediate cleaning or the change of linen. Those optional services have to be reserved in advance and are subject to the payment of a supplement fee.
The booking fee has to be paid by the Client to guarantee the reservation. The amount of the booking fee is the 30% of the total rental price and it is payable by means of bank transfer or by means of credit card. Using the bank transfer, the Client has to send a copy of the transfer payment’s receipt within 48 hours to Venice homes & holidays by fax or email.
The balance must be paid at least 20 days before the arrival date.

For Last Minute booking (less than 20 days before the arrival date), to confirm the reservation the Client must pay the total rental price.

Using the bank transfer, all the bank charges have to be covered by the Client.

Filling up the space with a special promotional code/ coupon it will be possible to get a special discount on your booking. In this moment it is possible to use the following code:

- for the apartments Al Pozzo, Al Mercà Holidays, La Veranda, Corte dell’Edera e Marina, you could use the code Just2! : if you are just two guests and you would like to book a one bedroom apartment (so you will be less the maximum guests allowed), you will get a discount on the total price.

- for the apartments Ca’ del Nonno e Muazzo, you could use the code Just3! : if you are just three guests and you would like to book a two bedroom apartment (so you will be less the maximum guests allowed), you will get a discount on the total price.

CANCELLATION BY THE CLIENT

Cancellation by the Client will only be accepted in written form.
With a notice of at least 20 days prior to the arrival date, Venice homes & holidays will keep the booking fee (i.e. the 30% of the total rental price).
With a shorter notice, Venice homes & holidays will keep the following percentage:

  • from 20 to 15 days prior to the arrival date: 50% of the total rental price;
  • from 14 to 7 days prior to the arrival date: 75% of the total rental price;
  • from 6 days to 1 day prior to the arrival date: 90% of the total rental price;
  • the same day/ non-show: 100% of the total rental price.

The Client will not be entitle to any refund in case of voluntary interruption of the stay and following anticipated departure.

CANCELLATION BY VENICE HOMES & HOLIDAYS

In the unlikely event that the apartment booked by the Client shall not be available any more for real and justified reason or for events due to force majeure, Venice homes & holidays undertakes to inform the Clients as soon as possible keeping the right to propose to the Client another apartment similar to the one already booked. Should the Client not accept the proposed change, all obligation will be terminated and Venice homes & holidays will refund the Clients the amounts paid. No further amounts of whatsoever nature shall be due by Venice homes & holidays to the Clients.
Examples of “force majeure” could be strikes, bad weather conditions or flooding over the 160 cm, fires, civil problems or any other contingencies beyond the control of Venice homes & holidays.
The Client undertakes to exercise due care and diligence in using the Apartment, or Venice homes & holidays will keep the right to terminate immediately the rental contract without any claim for indemnification by the Client.

SECURITY DEPOSIT

The Client shall be required to provide a security deposit upon arrival (by means of credit card, Euro cheque or cash amount) to cover any breakage or damages to the apartment or to its furniture and equipments caused by the Client during the rental period. The security deposit will be given back to the Client at the end of stay, after the check of the apartment by a Venice homes & holidays’ representative. The Client agrees and accepts that Venice homes & holidays will be entitle at any time to withdraw from the security deposit any amount due by the Clients for breakages or damages, without prejudice to Venice homes & holidays’ right to claim compensation for any further damage caused or for the difference between the amount of the security deposit and the amount of the damage.
If the Client should anticipate the departure, the Clients authorizes Venice homes & holidays to keep the security deposit until the staff member had checked the apartment.

TERMS OF CONSIGNMENT AND RELEASE OF THE APARTMENT

The Client is kindly asked to provide Venice homes & holidays with at least 7 days before notice the expected arrival time and any other necessary detail (flight/train number etc.) to organize the welcoming service. In lack of this information, Venice homes & holidays will not be responsible for any failure or delay in the welcoming service.
The apartment will be available after 03.00 p.m. of the arrival day and it should be vacated before 11.00 a.m. the departure day; only according to the availability of the apartment other timings could be arranged. The welcoming service between 07.00 p.m. and 01.00 a.m. has a supplement fee of 50,00 euro. The welcoming service after 01.00 a.m. is possible only on request and the supplement fee will be confirmed by Venice homes & holidays.
At the agreed time, an employee of Venice homes & holidays will welcome the guests at the closest vaporetto stop to show them the way to the apartment, to hand over the keys, to show them the apartment and how to use the equipments and to give them all the information they would need.
At the apartment keys collection, the Client will be required to sign all necessary documents for his registration according to the Italian Law. For a more than 14 nights renting period, the Venice homes & holidays’ representative will read the meters. The Client will be required to pay to Venice homes & holidays’ representative the services not included in the rental price (like the late check-in fee, the intermediate cleaning, the change of house linens, and so on). The Clients has to arrange with Venice homes & holidays’ representative the appointment for the check-out at the end of stay.
At the check out, the Venice homes & holidays’ representative will check the apartment and read the meters of electricity, water and gas (only for more than 14 nights renting period). The Clients has to give back to the Venice homes & holidays’ representative all the apartment keys.

MAXIMUM NUMBER OF PEOPLE ALLOWED

Every description states the maximum number of people the apartment can sleep. The Client agrees to respect the maximum number of persons entitled to occupy the Apartment.
During the check in, or even before the arrival (by fax or e-mail), the Client has to present a copy of a valid document for all the people who will stay in the apartment.
Unless expressly written authorization of Venice homes & holidays, any kind of animal will be allowed to enter the apartment.

CLEANING

The apartment will be delivered to the Client by Venice homes & holidays thoroughly clean, provided with linen and towels in adequate quantity for the number of guest and equipped with all fittings stated in the description of the apartment.
After the Client’s departure, a Venice homes & holidays’ staff member will take care of the final cleaning. Before leaving the apartment, the Client must clean the kitchen/kitchen corner, empty the fridge from all the perishable items and remove the rubbish, taking it in the dustbins or outside the apartment respecting the local laws for the recycling system.

LIABILITY FOR THE CLIENT

The apartment can only be used for temporary and tourist house-hold needs. It is strictly forbidden to set the residence in the apartment or to choose the apartment as permanent house-hold, neither exercise any commercial activities or develop any type of enterprise in the apartment. It is furthermore not allowed to sublet the apartment, or part of it, to third parties, or Venice homes & holidays will keep the right to terminate immediately the rental contract without any claim for indemnification by the Client.
The Client agrees not to cause any noise or nuisance that may in any way disturb the residents of in neighboring apartments, especially between 01.00 pm and 03.00 pm and from 10.00 pm and 08.00 am. Should the Client not follow the rules established by the building and those by Venice homes & holidays, the latter keeps the right to expel them with no right to any refund.
The Client agrees to take reasonable care and adopt the necessary safety measures to avoid unauthorized persons from accessing the Apartment for the entire duration of the rental period. In the case of failure to comply with the said obligation, the Client shall be liable to Venice homes & holidays for any damage caused to the Apartment and/or its furniture, equipment and accessories. Loss of keys will entail compensation of the cost of new locks and of 4 sets of keys. In case the Client left or damaged the apartment’s keys or he acted so that a technician will be needed to open the door, the fee is 90,00 € including the lock’s replacement. Other extra fees like the supplement for bank holiday or outside the working hours are not included in the price. The fee for calling a Venice homes & holidays’ Staff member for any emergency caused by the Client will be of 40,00 Euro.
The Client undertakes to exercise due care and diligence in using the Apartment, refraining from any act which may damage the apartment or its furniture, equipment and accessories and to return the apartment in the same manner as the arrival day. Any damage caused to the apartment by the Client must be refunded to Venice homes & holidays.
In case of problems during the stay, the Client is kindly requested to contact Venice homes & holidays’ Staff, who will try to solve the problem as soon as possible. Any complaints presented after the Client’s departure will not be entitled to any refund or compensation from Venice homes & holidays. Venice homes & holidays will not be liable to the Client for any suspensions/ interruptions beyond its control of the electricity, gas and/or water supply, or for the breaking of mechanical parts like pumps or boilers.

APPLICABLE LAW AND JURISDICTION

The contract stipulated between the Client and Venice homes & holidays is guided by Italian law dispositions and subject to the exclusive jurisdiction of the Italian Court. Any dispute arising out or in connection with the present conditions shall be settled in an amicable way, and only when this solution should not be possible, throw the authority of the Justice of the Peace at the Chamber of Commerce of Venice.

PRIVACY

Venice homes & holidays is the holder of the treatment of the personal data provided by the Client and informs you, according to art. 13 of D.Lgs. 196/03 (Decree-Law on Privacy Code), that the data you supplied will be treated only for fulfilling the contractual obligations deriving from the contract for turistic lease.
